Participant Responsibilities:
I understand that it is my responsibility to: (1) wear proper clothing including gloves, long pants and closed toed shoes; (2) listen carefully to the instructor and be aware of my surroundings; (3) cease participation if at any time I feel like I am in danger (4) ask questions if I do not understand anything.
If I am participating in a Raku or Pit Firing, I agree to wear a mask for my own safety.
Informed Consent & Assumption of Risk:
I, the undersigned, being aware of the physical size, and nature of the Kiln Prep, work and Firing itself, and being aware of my own abilities and physical condition, and having knowledge that my participation in the Kiln Build Workshop may cause serious injury or even death, am voluntarily choosing to participate in the Kiln Build Workshop. In making the Kiln Build Workshop available for my participation, Clay Creations Studio, Margaret Tassi, Pat Avila and/or their agents, employees and heirs assume no responsibility for my injuries or any property damage that may result to my property from this workshop. The responsibility is assumed entirely by me, the participant.
I AM AWARE THAT FIRING WITH CLAY CREATIONS MAY SUBJECT ME TO PHYSICAL RISKS AND DANGERS, INCLUDING SERIOUS INJURY AND DEATH. NEVERTHELESS, I VOLUNTARILY AGREE TO ASSUME ANY AND ALL RISKS OF INJURY OR DEATH, AND PROPERTY DAMAGE, AND TO RELEASE, DISCHARGE, AND HOLD HARMLESS ALL OF THE ENTITIES OR PERSONS MENTIONED ABOVE WHO, THROUGH NEGLIGENCE OR CARELESSNESS, MIGHT OTHERWISE BE LIABLE TO ME, OR MY HEIRS, PERSONAL REPRESENTATIVES, RELATIVES, SPOUSE OR ASSIGNS.
Waiver & Indemnity:
In consideration of being able to participate, I, for myself, my heirs, personal representatives and assigns, do hereby release, waive, discharge and covenant not to sue Clay Creations Studio, Margaret Tassi or Pat Avila or and their respective agents, employees, affiliates, heirs, assigns, and representatives, (collectively, the "Releasees") from any and all claims including, not by way of limitation, any claims arising from negligence of Releasees or any of them in resulting in personal injury, accidents or illnesses (including death) and/or property loss arising from or relating in any way related to participation in the Kiln Build Workshop.
I agree to indemnify and hold harmless Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorneys’ fees and costs, and to reimburse Releasees for any such expenses incurred in connection with or as a result of (1) Participant’s participation in the workshop or firing event or (2) arising in connection with or as a result of any attempt by anyone, including, not by way of limitation, Participant or anyone claiming on Participant’s behalf, to avoid the terms of this document which I freely sign.
I have read this document in its entirety, fully understand its terms, and understand that I am giving up substantial rights — including my right to sue. I know, understand and appreciate these and other risks that are inherent in the Kiln Build Workshop. I expressly agree and assert that participation in the Kiln Build Workshop is voluntary and knowingly assume all such risks, known and unknown, and elect to proceed with the participation despite all the risks. I acknowledge that I am signing this document freely and voluntarily and intend, by my signature, the complete and unconditional release of all liability to the greatest extent allowed by law.
